Terms and Conditions

The SUBSCRIBER by initiating or subscribing to and using the services of the COMPANY agrees to the following:

Services are provided on a month-to-month basis with a minimum period of one month unless otherwise noted. The individual signing this agreement must be at least eighteen (18) years of age and personally guarantees all payments and the fulfillment of all terms of this agreement.

Title to and ownership of all equipment (other than SUBSCRIBER owned and maintained equipment) and telephone number(s) are retained by the COMPANY. Service may be terminated by the SUBSCRIBER or by the COMPANY at any time. When termination is initiated by the SUBSCRIBER, thirty (30) days written notice is requested.

The SUBSCRIBER hereby waives any claim against the COMPANY which may arise out of the use of any service provided. The sole liability of the COMPANY for loss or damages arising out of mistakes, omissions, delays, errors, or defects in the service or its transmission, shall not exceed an amount equivalent to the proportionate charge to the SUBSCRIBER for the period during which the mistake, error or failure occurred, not to exceed thirty (30) days.

The COMPANY is not liable for any act or omission of the provider of non-COMPANY facilities used in providing service, interruptions, errors, delays, or defects in transmission, or failure to transmit, when caused by acts of God, fire, war, riots, Government authorities, or other causes beyond the control of the COMPANY.

The SUBSCRIBER indemnifies and saves the COMPANY, and its officers, agents and employees harmless against any and all loss, damage, cost and expense, which the SUBSCRIBER may hereinafter suffer, incur, or be legally obligated to pay by reason of the provision of service above referenced by the COMPANY to the SUBSCRIBER; any claim for libel, slander, or infringement of copyright from the material transmitted over its facilities; against claims of infringement or patents arising from, combining with, or using in connection with facilities of the COMPANY, apparatus and systems of the SUBSCRIBER; and against all other claims arising out of any act or omission of the SUBSCRIBER in connection with facilities or services provided by the COMPANY.

Deposits will be returned to the SUBSCRIBER with interest within twenty-one (21) days after termination of service or upon establishment of sufficient credit history with the COMPANY. The SUBSCRIBER must make a written request to the COMPANY when requesting a refund of any deposit monies unless the SUBSCRIBER or COMPANY terminates service as herein provided. If termination of service occurs beyond the initial contract period the effective date of such termination shall be the last day of the month in which notice of termination is given to the COMPANY by the SUBSCRIBER.

Rates are subject to applicable Sales Taxes and a Telecom Services Surcharge to recover charges imposed by the Access Charge Reform Order, Universal Service Order, as well as other regulatory fees, taxes and surcharges.

This Application must be accompanied by the appropriate initial payment, service initiation fee and deposit as required.

Service Policies

Personalized Telephone Answering Service, Order-Taking Service and Voice Mail Service is provided by using your choice of available call forwarding options.  By forwarding your calls to your own special number at Phonepower®,  your calls will be answered promptly and professionally according to your customized instructions.

Service is provided any time you need it, 24 hours a day, 7 days a week, even on holidays.  If you have no local phone service, a number answered in your name is provided for your exclusive use, as long as you subscribe to our service. 

You are billed according to the amount of time you and your callers use each billing period, with time measured in tenths of a minute.  Billable time includes time spent taking and relaying messages, patching, voice, tone-only and digital paging, account updates and check-in time, as well as time used taking "special" or temporary instructions.  Hold time is not charged.  

Service may commence upon payment of the Set-Up charges and the first months basic service charges, along with any deposits that may be required.   Statements are rendered monthly, in advance, and are due net upon presentation.   A 1.5% FINANCE CHARGE (equivalent to 18% annual interest) is added to amounts due but not paid by the 22nd of the month in which billed.  Message counts are based upon the period commencing on the 20th of one month and concluding on the 20th of the following month.  Charges for additional message minutes beyond those included in the base rate, and other miscellaneous charges, appear on the next monthly bill.  Telephone numbers assigned by Phonepower® for the exclusive use of a client remain the property of Phonepower®, and may not be retained by the client when service is terminated, nor moved to any other location.

Accounts with monthly basic charges totaling $20 or less will be billed on a Quarterly basis.

Supplemental Charges

There is a one-time installation charge by the telephone company to install call forwarding.  Monthly charges for call forwarding and secretarial connections are billed by the phone company (directly to you) at the prevailing rates. 

All rates for services are subject to periodic review.  Adjustments may be made, based upon your call volume, or if you have special requirements which necessitate our Telephone Secretaries spending additional time handling your calls.

Additional charges may be applied for

  • Service Connection and account setup

  • Delivery of a message more than once at the Subscriber's request

  • Subscriber-provided SPECIAL FORMS for taking messages or orders

  • Subsequent attempts ("Trace Calls") to deliver messages after the first attempt

  • DIRECTORY creation and maintenance

  • Answering-Service-originated LOCAL calls made at the Subscriber's request

  • Message TOLL CALLS for Long Distance calls made on behalf of the Subscriber

  • Inter-connecting ("PATCHING") caller/Subscriber for the duration of the call

  • Additional LINES for the same client

  • Additional CLIENTS sharing the same line

  • White Pages DIRECTORY LISTINGS of Phonepower®-provided numbers showing the Subscriber's name.  This charge is billed annually in advance.   Such numbers are proprietary to Phonepower®, and may NOT be retained if service is terminated.
